Welcome, and thank you for your interest in TrustedSite, LLC ("TrustedSite," "we," or "us") and your use of the websites made available by TrustedSite including trustedsite.com and mcafeesecure.com ("Websites"), browser extensions made available by TrustedSite ("Browser Extensions"), and other services provided by us (collectively, the Websites, Browser Extension, an any other services provided by TrustedSite, our "Service"). These Terms of Service are a legally binding contract between you and TrustedSite regarding your use of the Service.

PLEASE READ THE FOLLOWING TERMS CAREFULLY. BY CLICKING THE "I ACCEPT" BUTTON, THE CHECKBOX IN THE REGISTRATION PAGES OF THE SERVICE, OR BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING THE TRUSTEDSITE PRIVACY POLICY AND ANY OTHER TERMS INCORPORATED HEREIN BY REFERENCE (COLLECTIVELY, THESE "TERMS"). IF YOU ARE USING THE SERVICE ON BEHALF OF AN ENTITY, ORGANIZATION, OR COMPANY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO BIND THAT ORGANIZATION TO THESE TERMS AND YOU AGREE TO BE BOUND BY THESE TERMS ON BEHALF OF THAT ORGANIZATION (YOU, OR THE ENTITY YOU REPRESENT, IS REFERRED TO AS "CUSTOMER").

If Customer is an individual using the Service for personal, family, or household purposes (a "Consumer"), these Terms provide that all disputes between Consumer and TrustedSite will be resolved by BINDING ARBITRATION. CONSUMER AGREES TO GIVE UP THE RIGHT TO GO TO COURT to assert or defend Consumer's rights under these Terms, except for matters that may be taken to small claims court. Consumer's rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury, and Consumer's claims cannot be brought as a class action. Please review the section below entitled "Dispute Resolution and Arbitration" for the details regarding Consumer's agreement to arbitrate any disputes with TrustedSite.

Definitions

  1. "Devices" means computer hardware, network, storage, input/output, or electronic control devices, or software installed on such devices.
  2. "IPs" means Internet Protocol addresses.
  3. "Network Security Audits" are audits conducted to ascertain the compliance of Devices with certain security standards published on the applicable Website and to disclose security vulnerabilities and may include, but are not limited to, port scanning and port connections, evaluating services by checking versions and responses to certain requests, and crawling a website to perform testing of forms, application responses, or to confirm the existence of certain files.

Service Overview

The Service includes (but is not limited to) the provision of TrustedSite's McAfee SECURE certification service for websites, a service that performs Network Security Audits on websites, McAfee SECURE Safe Browsing Plug-In for Consumers, a browser extension that performs certain Network Security Audits to certain websites that the Consumer visits, and the TrustedSite website which allows Customers to post reviews and ratings regarding the security of certain websites and allows website owners to manage those reviews, and TrustedSite Insights, a browser extension that provides value-based information about websites.
